Explaining the 21 Day FEIS Filing Appeal Deadline

Explaining the legal choice of fighting Northstar Chemical.

While laws are black and white, legal research has shown that the City of Sumner 'Sepa Decision Letter' for the Northstar Chemical project is somewhat unprecedented.

The citizen's group attorney does not want to miss the deadline as per RCW 43.21 which describe the Washington State Environmental Policy Act laws.  I personally like that very much in an attorney because missing deadlines and filings costs more money in the end. 

I realize it may be just a dream at this point to take this next process action to assert the people's will against a potentially life threatening toxic chemical plant next to people and water. A dream because it costs money. We were not prepared financially. It takes community support there. Not being prepared to take this step it is what they count on and is how they win in the end.

I still can't believe we are under this threat again as the property owner was a willing seller. However, now that we are, it will probably cost more to fight later if the community wants to and we will lose standing on Final Impact Statement Adequacy. It is woefully inadequate. If you have read this FEIS document you will undoubtedly agree that while it provides some disclosures that we did not have before, it still fails to describe and anaylize 'the blending' and many other shortfalls that are better left to the legal wizards to describe in an appeal. I regret assuming that the wisdom of the higher powers would protect us indefinately. It is hard letting go of the fight and letting the developer get his project right next to us. Very hard!!! 

We can still fight the building permits once issued, but losing FEIS arguments is not going to help our situation much. Sorry community. I feel very bad, as one of the main opposers, to let us down like this.
